הגבלת אחריות

השרות מבוסס על תוכנת בינה מלאכותית אוטומטית, טיב הזיהוי הוא סטטיסטי וקיים בו תמיד סיכוי לטעות. טיב הזיהוי משתנה מצילום לצילום גם עפ\"י צורת זוית ויכולת הצילום. הצילום הינו תלוי מכשיר ומצלמת המכשיר ואלו יכולים לשבש את איכות הזיהוי והתוצאה.המשתמש לא יקטוף או יאכל צמח\\פרח או כל אוביקט שהוא על פי ובהתבסס על תוכנת flowersAI וזיהוי האפליקציה והתוכנה. המשתמש מבין כי flowersAI לעיתים מזהה באופן שגוי ולכן תוכנה זו מיועדת רק לידע כללי. flowersAI לא תהיה אחראית בשום פנים ואופן לכל נזק ישיר או עקיף שעלול להיגרם כתוצאה מהשימוש באפליקציה.

ידוע למשתמש כי כדי שהאפליקציה תזהה מחויב קשר אינטרנט רציף בין האפליקציה לשרת ולכן באיזור ללא קישור לאינטרנט אין האפליקציה יכולה לעבוד ובודאי לא לבצע תהליך זיהוי.

שרתי flowersai נמצאים בשירות ענן. למרות משנה הזהירות בו האפליקציה נוקטת, אין ביטחון שלא תתבצע חדירה בלתי מורשית למאגרי המידע של flowersai על ידי גורם חיצוני. אי לכך, אין flowersai מתחייבת שמאגרי המידע ושירותי האפליקציה יהיו חסינים לחלוטין מפני חדירה בלתי מורשת למאגרי המידע.

חשבון משתמש

שימוש בשירות זיהוי flowersAI ונתוני ייעוץ אינם מחייבים יצירת חשבון משתמש, אך בחלק מהשירותים כעת או בעתיד תיתכן פעולה הנחוצה רישום או חשבון לשימוש בשירות.

שרותי flowersAI העיקריים

זיהוי הצמח על פי התצלום וזיהוי התמונה הדיגיטלית מבוסס טכנולוגיה ובינה מלאכותית, לעיתים תוך שימוש בתאריך, בשעה ובמיקום התצפית, שימוש אופציונלי בקואורדינטות ה- GPS של מיקום התצפית, שם היישוב, צילום במצלמה ושמירת קבצים למכשיר, אם אפשרויות אלה מופעלות במכשיר שלך ו\\או הופעלו\\יופעלו ע\"י השירות בשלב זה או בעתיד. לצורך זה ועפ\"י דרישות המכשיר הספציפי, ישמר ויקרא מידע מכל סוג שהאפליקציה צריכה על המכשיר בהתאם להרשאות שנתת לשירות.

חלק מהתמונות ושאילתות של המשתמשים, וחלק מהיסטוריית שאילתות ותוצאות משויכות למשתמשים ונשמרים במכשיר ובשרתי החברה. אנו מאחסנים את נתוני, תוצאות השרות והביצועים של המשתמשים ובכללם פרמטרים כמו סוג המכשיר והמשמש סוג השאילתה מאפייני התמונה ואת התמונה לכל שאילתה ועוד.

נתונים אלה עשויים לשמש כחלק מעבודות מחקר IT ו- AI על ידי flowersAI.

כאשר המשתמש מחובר, המספר של החשבון המשויך יישמר יחד עם השאילתה. כמו כן איסוף נתוני המיקום והזמן ישמרו.

שרות flowersAI רשאי להשתמש בשרותי גוגל אנליטיקס או כל שרות צד שלישי אחר לאיסוף וניתוח צורת השימוש של המשתמש באפליקציה, וזאת מבלי לאהעביר פרטים אישיים של המשתמש.

שימוש ביישום flowersAI

כל הנתונים והתמונות המוצגים ומועלים ביישום זה חייבים להיות תואמים לחוקים ולתקנות הישראליים החלים. אתה מתחייב במפורש שלא להשתמש בתמונות או מילים גזעניות, פורנוגרפיות או משמיצות באפליקציה. זכור כי אתה אחראי לחלוטין על התוכן שאתה מפיץ וכי flowersAI לא ייחשבו כאחראים לתוכן שהעלת, שמרת, שלחת או יצרת.

זכויות וחובות המשתמשים

ללא אישור בכתב flowersAI, המשתמש אינו רשאי להעביר, להפיץ ו/או לשכפל כל מידע או תמונה אשר מוגן בזכויות יוצרים, סימן מסחרי, או כל מידע ששייך לבעל קניין רוחני.

המבקרים אחראים לפרשנותם ולשימושם במידע, ולנתונים שהם מספקים על טפסים הכלולים באתר. הם מחויבים לכללים ולתקנות הרווחים.

זכויות קניין רוחני

שום אלמנט ביישום ה- FlowersAI לא יועתק, ישועתק, ישונה, יפורסם מחדש, יורד, יעוות, יועבר או יופץ, ככל שיהיה, באופן חלקי או אינטגראלי, ללא אישור בכתב ומראש של FlowersAI.

התוכן והמידע שהמשתמש מפרסם על FlowersAI שייכים לך. אתה מתחייב ל- flowersAI שהתוכן והמידע שאתה מפרסם ב- flowersAI אינם מפרים זכויות של צדדים שלישיים כלשהם ולא מוגבלים, לכל זכויות קניין רוחני או זכויות פרטיות.

אתה מסכים להעניק ל- FlowersAI את הנתונים שלך, כמתואר לעיל.

במסגרת רישיון זה, כל אדם יהיה רשאי לשחזר, לשנות, להפיץ ולהעביר את הנתונים שלך, כמתואר לעיל, לציבור בתנאים הבאים:

ציין את שם המחבר המקורי של היצירה ושם של flowersAI.

אם חל שינוי, שינוי או עיבוד, אתה נותן את הזכות להפיץ את היצירה המתקבלת רק ברישיון זהה לזה.

מידע אישי

במידה ותידרש בהווה או בעתיד, בהרשמתך ליישום flowersAI, אתה מאשר שזהותך, תחת השמות, שמות המשפחה וכתובת הדוא\"ל שציינת בעת ההרשמה, מתפרסמת בשיתוף עם התוכן והמידע שאתה מפרסם באמצעות היישום flowersAI.

נתונים אלה יאוחסנו עד לביטול החשבון.

כל אדם רשאי:

איסוף מידע
אנו עשויים לאסוף את המידע הבא:
- מידע שאתה מספק ישירות (שם, כתובת דוא"ל)
- מידע על המכשיר (סוג מכשיר, מערכת הפעלה, מזהים)
- נתוני מיקום, תמונות, קבצים
- נתוני שימוש – זמני שימוש, מאפייני שאילתות

מטרות השימוש במידע
אנו משתמשים במידע שלך כדי:
- לספק את השירותים שלנו
- לשפר את הביצועים והתכנים

שיתוף מידע עם צד שלישי

כללי

כל תנאים נתונים לשינויים ע\"י FlowersAI בכל עת בלא מתן הודעה מראש למשתמש.

בכל מקרה של סכסוך או מחלוקת בין הצדדים בהקשר לנושא התקנון לרבות תנאי השימוש בו וכל הנובע מהם ו/או הכרוך בהם תהא סמכות שיפוט ייחודית לבית המשפט המוסמך בתל אביב.

על תקנון זה ותנאיו יחולו דיני מדינת ישראל והם יפורשו על פיהם בלבד.

These terms and conditions define the conditions under which you may access and use the various services available in flowersAI. All users of the services offered by flowersAI accept the current terms and conditions.

Limitation of Liability

The service is based on an automated artificial intelligence software. The quality of identification is statistical and there is always a possibility of error. The quality of identification varies from photo to photo depending on angle, lighting, and camera capability. The photo is device-dependent and may affect identification quality and result. The user must not pick or eat any plant/flower or object based on or relying on the identification results of the flowersAI software. The user understands that flowersAI sometimes makes incorrect identifications and is therefore intended for general informational purposes only. FlowersAI shall not be liable in any way for any direct or indirect damage that may result from using the app.

The user understands that a continuous internet connection is required for the app to function. In areas without internet access, the app cannot operate or perform identification.

FlowersAI's servers are hosted on a cloud service. Despite the precautions taken by the app, there is no guarantee that unauthorized access to the data stored on flowersAI will not occur by external actors. Therefore, flowersAI does not guarantee that its servers and services are completely secure from such access.

You confirm that you understand and accept that under no circumstances will flowersAI be responsible for the creation, modification, corruption, or deletion of your personal data, which remains fully your responsibility. You use flowersAI at your own risk. In no case will flowersAI be responsible for any direct or indirect damage, data loss, or financial harm related to access or use of the app. All content in flowersAI is presented without any guarantee. You are fully responsible for any damage to your phone or data loss resulting from the use of the app.

In no case shall flowersAI be responsible for the accuracy of the identification results provided by the software.

The user understands that the number of identifiable plants is limited and subject to change according to updates made by flowersAI.

User Account

Use of the flowersAI identification service and advice data does not require account creation, but some current or future services may require registration or an account to access the service.

Main flowersAI Services

Identification of plants based on digital photos, using technology and artificial intelligence, sometimes using date, time, and observation location, optionally using GPS coordinates, locality name, camera access, and file saving, if such permissions are granted and supported by your device or the service at present or in the future. Accordingly, information may be stored or accessed as required by the app and the permissions you've granted.

Some user queries, photos, and portions of query history and results are stored on the device and the company’s servers. We store data, results, and performance parameters such as device type, query type, photo characteristics, and the image per query.

This data may be used for IT and AI research by flowersAI.

When the user is logged in, the associated account number will be stored with the query. Location and time data may also be saved.

FlowersAI may use Analytics or other third-party services to collect and analyze user behavior within the app, without transmitting personal identifying information.

Use of the flowersAI App

All data and images uploaded or displayed must comply with applicable Israeli laws and regulations. You explicitly agree not to upload offensive, racist, pornographic, or defamatory content. You are fully responsible for the content you upload, save, send, or create, and flowersAI is not responsible for any such user-generated content.

User Rights and Obligations

Without written consent from flowersAI, users may not transfer, distribute, or duplicate any content or images protected by copyright, trademarks, or any intellectual property rights.

Visitors are responsible for interpreting and using the data, and for information provided on forms available on the site. They must comply with applicable rules and regulations.

Intellectual Property Rights

No element in the FlowersAI app may be copied, duplicated, modified, republished, downloaded, distorted, transmitted, or distributed in whole or in part, without prior written consent from FlowersAI.

Content and data published by users on FlowersAI remain their property. By submitting them, you warrant that the materials do not violate third-party rights, including intellectual property or privacy rights.

You agree to grant FlowersAI access to your data as described above.

By using the flowersAI app, you agree to transfer your content and data (photos of flowers, general images, and associated username, date, and location) to flowersAI servers and staff, and you agree to make this content available now or in the future to other flowersAI users.

Under this license, anyone may copy, modify, distribute, and transmit your data, as described, under the following conditions:

- You must credit the original author and FlowersAI.

- If the data is modified or processed, the new version must be distributed under the same license.

Personal Information

If required now or in the future, by registering to the flowersAI app, you confirm that your identity, including name, surname, and email address, will be associated with the content you publish on the app.

This data will be stored until the account is deleted.

The legal basis for processing is:

- Fulfillment of the FlowersAI service agreement.

Each individual is entitled to:

- Confirm whether personal data concerning them is being processed, and if so, access such data.

- Request correction or deletion of personal data, request processing restrictions.

- Request data portability if processing is based on consent or contract. Individuals may also object, on legitimate grounds, to the processing of their data. Objections must be submitted via email or in writing to FlowersAI.

We may collect the following information:
- Information you provide directly (name, email address)
- Device information (device type, OS, identifiers)
- Location data, images, files
- Usage data – usage time, query details

Purpose of Data Use
We use your data to:
- Provide our services
